Migrating from High Sierra to Big Sur

I finally upgraded to a new iMac running Big Sur and tried to use migration assistant to transfer everything across however it wouldn't transfer as the files on the old computer running High Sierra are case sensitive and Big Sur is apparently not. The old computer will not upgrade past High Sierra.
I then tried to use a Time Machine back up with migration assistant but although the Time machine backup is visible on the desktop the assistant can't see it.
Where to next? I'm hoping for an easy fix.

-Did you try Migration Assistant (MA) via WiFi from the old to new Mac?
-Did MA give an error with regards to case-sensitivity?
-Is the Time Machine drive connected to the new iMac directly, or the old Mac?
