OSX 10.8.5 upgrade fails.

I have an after market Macbook Pro running OS x 10.8.5, all attempts to upgrade to 10.9 have failed. Downloading 10.9 from the apple store multiple times always fails indicating corrupted data when I attempt to load. Load from USB fails. Downloading and copying from another Macbook Pro fails also. This leads me to believe my operating system is not a licensed copy. How do I purchase or load a legal copy? If I buy the 10.8 CD will it load over the current copy and not delete my data? Please advise.

Apple sells it for the price of the media, contact your local Apple Reseller for the correct version.
